1. Area of application
The product range of the ETH Store AG (merchandise items with the ETH logo) and the ETH Store Genossenschaft (stationery, books, services) can be purchased on the grounds of the ETH Zurich, (and a sub-range in the Shop ITZ, Toni-Areal Zurich) and in occasion of university events. Orders can be made at any time in the online shop. Our products are open to everybody. The pricing policy of the ETH Store foresees, wherever possible, an advantageous internal school price for students and members of universities, which can be fully taken advantage of with your ID when purchasing.
When you access our online shop with the ETH log-in details, you can visualize the internal school prices, provided that your log-in details have the appropriate authorization level. Customers without the appropriate ID can take advantage of the also very attractive external school prices in the ETH store. The general terms and conditions (hereinafter referred to as the "GTC") of the ETH Store AG and the ETH Store Genossenschaft (hereinafter referred to as the "ETH Store) apply to all products and services of the ETH Store (hereinafter referred to as the "Products"). A "Customer" is any natural or legal person who engages in business relations with the ETH Store.
The following GTC shall apply exclusively in their valid form at the time of the order. The ETH Store does not recognise any differing conditions of the purchaser, unless the ETH Store has expressly agreed so in writing.
2. Services and information
The ETH Store presents the product information relating to the products shown in the online shop as clearly as possible. Insofar as this concerns information supplied by the manufacturer, such information is considered decisive. The ETH Store endeavours to indicate correctly the manufacturer’s information, but no responsibility can be taken for it.
3. Contract conclusion
Your order constitutes an order for us to conclude a sales contract. A sales contract is only then concluded when we send the product you ordered to you or when you come and pick it up in person. No sales contract is concluded for products from the very same order that are not listed in the notice of delivery. The ETH Store Genossenschaft is the contractual partner. Not all products listed in the online shop are also in stock across the ETH Store outlets.
4. Payment and delay
The prices quoted in the ETH Store outlets and the online shop are incl. VAT and are given in Swiss francs. In the outlets there is also the opportunity of paying in cash or by debit/credit cards. The ETH Store offers institutional customers the option of applying for a customer card and paying by invoice.
The customer agrees to pay for the order with the payment methods provided when using the online shop. Paying in cash is also possible if you decide to pick your purchase up directly. The ETH Store reserves the right to refuse particular methods of payment without giving an explanation to the customer. If a credit card is used when making a purchase, then the corresponding amount will be deducted from the credit card account and the goods shipped out. If the purchaser finds themselves in default of payment when making a purchase, then the ETH Store is entitled to demand interest totalling a maximum of 5% above the base rate of the Swiss National Bank p.a. If the ETH Store accrues a higher damage caused by default, then they are entitled to claim this back. The invoice amount is due upon receipt of invoice. You are not able to complete payment by sending cash or cheque. The customer is responsible for any losses incurred.
Provided that we have the ordered products in stock in our warehouse, they shall be passed on for dispatch within 1-3 working days, or be made readily available for pick-up in an ETH store outlet. Otherwise, a written order confirmation will be sent out by email with the expected delivery date. The recipient shall pay a flat shipping rate of CHF 10.- including VAT for deliveries within Switzerland and the Principality of Liechtenstein. Delivery is free of charge for orders of CHF 150.- and over. Additional costs shall be charged for international dispatch. Additional customs fees may also apply in the destination country. These must be paid by the orderer.
Unless agreed otherwise, delivery is made from the warehouse to the address specified by the orderer. The ordered products can only be dispatched to one address. If an order leads to a partial delivery, then the shipping costs shall only be charged once. The delivery of the goods is at the expense and risk of the customer, even in the case of partial deliveries. All information specified on availability, dispatch or shipment are only estimates and are approximate guideline values. If the ETH Store discovers during the processing of your order that the products you ordered are not available, then we will inform you of this separately by email or telephone.
7. Reservation of proprietary rights
The supplied good shall remain the property of the ETH Store Genossenschaft until full payment is made.
8. Exchange or returns policy
The customer has no fundamental right of return. Incorrectly ordered goods can only be returned after consultation and with consent. Changes requested by the customer are only possible in exceptional cases and at the sole discretion of the ETH Store. The possibility of cancellation is also dependent on the product. Exchanges and complaints may only be considered within 7 days of receipt of the goods. Reduced items cannot be exchanged. Cancellation must take place in writing or by returning the unused goods in person or by post. Any costs incurred in such a process shall be borne by the orderer. A copy of the order documents must be enclosed when returning the goods by shipment or the original receipt/invoice when doing so in person. No right of exchange shall be granted with goods that have been produced according to the customer's specifications or evidently tailored to the personal requirements of the customer. Postage and shipping costs are non-refundable. The credit note may be reduced by the ETH Store by any expenses and costs actually incurred and will be refunded in the form of a voucher.
9. Right to cancellation and the consequences of cancellation
Right to cancellation:
The orderer may cancel the contract declaration within two weeks without stating reasons, either in written form (e.g. letter, e-mail) or - if the item is transferred to them before the period has expired - by returning the goods by post or in person.
The period begins upon receipt of this notification in writing, but not before receipt of the goods by the recipient (in case of recurring deliveries of the same goods, not before receipt of the first partial delivery) and also not before fulfilment of the statutory information requirements. To comply with the cancellation period, it is sufficient that the cancellation or return of the goods be sent in good time.

Consequences of cancellation:
In the event of an effective cancellation, the mutually received payments or goods are to be restored and, if necessary, any profit drawn (e.g. interest or a user fee for the use of an item) must be returned. If the customer cannot return the product received to the ETH Store, either totally or partly or only in deteriorated condition, the customer must compensate the ETH Store in this respect and if necessary. In the case of retuning the goods directly, this is not applicable should the deterioration of the goods be due exclusively to its testing - similar as to what would be possible in-store. For the rest, the customer may avoid the obligation of paying compensation for deterioration of the goods, as a consequence of the intended use of the item (i.e. using it only for the purpose for which the product is designed and intended for), by not using the product as they would their own property and not doing anything that may result in a value loss.
Dispatchable goods are returned at the risk of the orderer. The orderer shall bear the cost of return shipment if the delivered goods correspond to those ordered. Otherwise, the return is free of charge. The orderer must fulfil their obligations to obtain the refund of the payments within 30 days after sending the notice of cancellation. The period begins with the sending of the notice of cancellation or return of the goods; for the ETH Store, upon receipt of the goods.
The right of cancellation does not apply to:
- the delivery of goods that are made according to the customer's specifications or are evidently tailored to personal requirements or are not suitable for return due to their condition or are easily perishable or would be past their expiration date,
- he delivery of audio or video recordings or software where the seal of the storage device has been broken by the consumer, or
- he delivery of newspapers, periodicals and magazines.
Product liability is generally excluded.
11. Data protection
For the collection, processing and utilisation of personal data, the provisions of the Swiss Data Protection Act and the relevant legal norms shall apply exclusively. All customer data that is gathered when the order is processed is only used for internal marketing and research purposes. The customer data will not be disclosed to third parties. Only those places that are responsible for processing your order (e.g. the post office) will be entrusted with accessing data that is absolutely necessary for them. The customer consents to this use of their data. In all other respects, they have the right at any time to access the data stored on them and to ask for it to be deleted and to prohibit the use of this for internal market research purposes.
12. Disclosure cooperations
The ETH Store online shop is the common online platform of the ETH Store AG (VAT ID: CHE-264.182.531 sales tax) and the ETH Store Genossenschaft (VAT ID: CHE-293-909.353 sales tax). The ETH Store Genossenschaft deals with the collection of receivables for the ETH Store AG. Both companies are partner organizations of the ETH Zurich.
13. Final provisions
a. Applicable law
Swiss law is exclusively applicable in case of dispute.
b. Place of jurisdiction
The place of jurisdiction is Zurich.
